Pre Settlement Funding, Or Lawsuit Advances, help plaintiffs get money before their ligitation is settled

PRE-SETTLEMENT FUNDING

WHEN IS PRESETTLEMENT FUNDING
OR A LAWSUIT ADVANCE
APPROPRIATE?

As we've said, Pre-Settlement Funding, or Lawsuit Advance Funding, should only be considered as a last resort. You should use this funding option when you have exhausted all other avenues for raising the money you need to finish your case. Below are some commonly seen examples of situations where an advance on your lawsuit could make the difference.

Some Common Examples:

EXAMPLE #1 - STAYING THE COURSE
HOW WILL YOU MAKE IT UNTIL THE CASE CLOSES?

- You are in the middle of your lawsuit. It appears to be a good case. You are injured and cannot work, but your attorney says it will be another 6 months before your case settles. You need money to live on until then. This is an excellent example of when a lawsuit advance could help.

Pre-Settlement Funding can provide you with the cash you need to get you through until your case is settled.

EXAMPLE #2 - REFUSE TO TAKE LESS THEN YOUR CASE MERITS

- Your lawsuit has been filed and the attorney believes you'll win a substantial amount of money. However, the insurance company realizes that your cash reserves are exhausted and you need to settle soon. Knowing this, they have delayed processing on the case and are now offering you a quick settlement amount that is a fraction of what your case is worth. If something doesn't happen soon to relieve your financial pressures, you will be forced to take it.

Don't settle for less then you deserve. A lawsuit advance can take the financial pressure off so that you can achieve a fair and just settlement.

EXAMPLE #3 - BRIDGING THE GAP & HOLDING THE DEFENDENT RESPONSIBLE

- The attorney has taken the lawsuit on a contingency basis, meaning he doesn't get paid until you get paid. However, he can't cover the costs of the case, such as extensive investigation, special testing, analysis and report generation, travel costs, expert witnesses and the like. Without these things, you're dead in the water and the defendent will get off scot free. You need money to bridge this gap.

Litigation Funding can help level the playing field, enabling you to see your case through to completion.
